Olive Notebook: Plant Journal Terms of Use

1. Application

These Terms set forth the conditions for using Olive Notebook: Plant Journal (the "App"). By installing or using the App, the user is deemed to have agreed to these Terms. Apple's standard End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies to the App when obtained from the App Store.

2. Conditions of Use

The App is provided for the user's own personal use.
Records in the App are stored on the device. Use the in-app backup feature as necessary to prepare for the loss of records caused by loss or failure of the device or deletion of the App.
Users must not improperly modify, analyze, or redistribute the App's features or use the App for a purpose that violates laws, regulations, or public order and morals.

3. Fees

The current version of the App is provided free of charge. If paid features are added in the future, their details and prices will be shown in the App, and they will be provided through the App Store.

4. Disclaimers

The App helps users organize and review records and does not guarantee the accuracy or completeness of their contents. Users are responsible for final confirmation of dates, items to bring, deadlines, and similar information.
The App does not provide medical, legal, or financial advice.
Except in cases of willful misconduct or gross negligence by the operator, the operator is not liable for damage arising from the use of or inability to use the App.

5. Changes to or Discontinuation of the Service

The operator may change the content of the App or discontinue its provision after giving prior notice.

6. Changes to These Terms

If these Terms are changed, the changes and their effective date will be shown in the App or on the public website.

7. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. The court having jurisdiction over the operator's location has exclusive agreed jurisdiction as the court of first instance for disputes relating to the App.

8. Cloud AI Features

Cloud AI output is reference information that helps users organize and review their records. Output may contain errors, outdated information, or omissions. Before adopting, saving, or using output, users must check their records and the condition of their plants.

Cloud AI does not do any of the following:

It will not identify a plant automatically.
It will not change reminders or schedules automatically.
It will not make definitive diagnoses or determine causes.
It will not guarantee treatment or recovery.
It will not instruct you how to use pesticides or fertilizers.
It will not determine toxicity, edibility, or harvest safety.
It will not direct you to advertisements.

AI suggestions are saved on the device only when the user explicitly adopts them. The user can choose whether to adopt or discard AI output.
